
Description of Community and Acceptance of Guidelines
The Alzheimer's Association online community ("Community") is a place where people can come together to share questions, ideas, triumphs and struggles that revolve around Alzheimer's disease and other dementias. We encourage you to be a part of this growing community of strength and support subject to the following guidelines, which may be updated by us from time to time without notice to you.

You understand and agree that the Community may include certain communications from the Alzheimer's Association, such as service announcements and administrative messages, and that these communications are considered part of your participation in the Community and you will not be able to opt out of them. Unless explicitly stated otherwise, any new features that augment or enhance the current Community shall be subject to these guidelines. You understand and agree that the Community is provided "AS-IS" and that the Alzheimer's Association assumes no responsibility for the timeliness, deletion, misdelivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Community, and that access may involve third-party fees (such as Internet service provider or airtime charges) and you must provide and are responsible for all equipment necessary to access the Community.
Your Registration Obligations:
In consideration of your use of the Community, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other application jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself when prompted and (b) maintain and promptly update your information to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or the Alzheimer's Association has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Alzheimer's Association may, in its sole discretion, suspend or terminate your participation in the Community and refuse any and all current or future use of the Community (or portion thereof) :
Personal information
It is important for you to remain aware that when you provide personal information (e.g., last name, address, phone number) in a posting on any message board, that information is available to any person who uses the message boards, and may be used by someone in a manner unintended by you. For that reason, we discourage you from offering any personally identifying information within a posting to any message board.
Member Conduct
All information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not the Alzheimer's Association, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Community. The Alzheimer's Association does not control the Content posted via the Community and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Community, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will the Alzheimer's Association be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available to you via the Community.
You agree not to use the Community to:
- upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
- impersonate any person or entity, including, but not limited to an Alzheimer's Association official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
- forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Community;
- upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
- upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
- upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail,", "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
- upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- cut or copy Content and then paste to yours or another's blog, chat room, or any other online communication and information tool;
- interfere with or disrupt the Community or servers or networks connected to the Community, or disobey any requirements, procedures, policies or regulations of networks connected to the Community;
- intentionally or unintentionally violate any applicable local, state, national or international law;
- "stalk" or otherwise harass another;
- reproduce, duplicate, copy, sell, trade, resell or exploit for individual gain or any commercial purpose; and/or
- Collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through l above.
The "Ask a Care Consultant" forum is monitored by Alzheimer's Association staff members on a daily basis. The other forums are not monitored as closely and you acknowledge that the Alzheimer's Association may or may not pre-screen Content. The Alzheimer's Association and its designees shall, however, have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or remove any Content that is available via the Community. Without limiting the foregoing, the Alzheimer's Association and its designees shall have the right to remove any Content that violates these guidelines or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content including any reliance on the accuracy, completeness, or usefulness or such Content.
You acknowledge, consent and agree that the Alzheimer's Association may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the guidelines; (c) respond to claims that any Content violates the rights of third parties; (d) respond to your requests for customer service; or (e) to protect the rights, property or personal safety of the Alzheimer's Association, its users and constituents, and the public.
A message board exchange may feel like an actual "conversation," but the rules of polite online behavior are different. In a message board exchange it is perfectly acceptable not to respond to everyone who responds to your message. This is particularly true if someone is taking the topic in a direction you didn't intend. Please try to keep in mind the main purpose of this online community is to provide support and education to those affected by Alzheimer's disease.
We have included a feature on the message boards called the "Ignore Feature." Members should use this feature to avoid seeing the posts of any user(s) they choose to ignore. For ignored users, replies in topics are hidden by default. In addition, you will not receive notifications of new content by ignored users and ignored users will not be able to start a Private Message with you.
How to use the Ignore List:
- Write down the display name of the user(s) you wish to ignore.
- Select "MY PROFILE" from the top navigation panel.
- Select "Ignore List" from the left menu options. This will open up your Ignore List window.
- To add someone to the list, click the "Add Users" link (near the top of the window). A pop up window will appear.
- Type in the Display Name you wish to ignore and click on search. You will then get a list of names that closely resemble what you have typed in.
- Put a check in the box next to the name you wish to ignore and click on "add selected members".
Another way to ignore a Display Name can be done right from a discussion. You start by clicking on the name you wish to ignore. A drop down menu will appear. Click on the option second from the top that reads, "add ‘name' to my Ignore List". You will still be able to see their post if that user starts a new conversation.
Pros and cons of a large electronic community
Our message board community has thousands of registered members, and is growing every day. Its size is one of its strengths. As you post and read messages, though, please be aware that electronic messages, often written quickly, are easily misconstrued. On a healthy message board, exchanges may heat up between community members who share different viewpoints. Communication in the online world exists without the normal signposts of facial expressions, body language and voice tone thereby emphasizing the meaning of the actual words. Given the challenges of online communication, it might be helpful to assume a positive intent.
Content Submitted or Made Available for Inclusion in the Community
The Alzheimer's Association does not claim ownership of Content you submit or make available for inclusion in the Community. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Community, you grant the Alzheimer's Association the following worldwide, royalty-free and non-exclusive license(s), as applicable:
- With respect to Content you submit or make available for inclusion on publicly accessible areas of the Community, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content in the Community solely for the purposes of providing and promoting the Community. This license exists only for as long as you elect to continue to include such Content on the Community and will terminate at the time you remove or the Alzheimer's Association removes such Content from the Community.
- With respect to photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Community, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Community is solely for the purpose for which such Content was submitted or made available. This license exists only for as long as you elect to continue to include such Content on the Community and will terminate at the time you remove or the Alzheimer's Association removes such Content from the Community.
- With respect to Content other than photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Community, the perpetual, irrevocable and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now in existence or later developed.
Contributions to the Community
By submitting ideas, suggestions, documents, and/or proposals ("Contributions") to the Community, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) the Alzheimer's Association is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) the Alzheimer's Association shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) the Alzheimer's Association may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of the Alzheimer's Association without any obligation of the Alzheimer's Association to you; and (f) you are not entitled to any compensation or reimbursement of any kind from the Alzheimer's Association under any circumstances.
Indemnity
You agree to indemnify and hold the Alzheimer's Association and its affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Community, your use of the Community, your connection to the Community, your violation of these guidelines, or your violation of any rights of another.
Use and Storage
You acknowledge that the Alzheimer's Association may establish general practices and limits concerning use of and participation in the Community, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Community, the maximum number of email messages that may be sent from or received by an individual in the Community, the maximum size of any email message that may be sent from or received by an individual in the Community, the maximum disk space that will be allotted on the Alzheimer's Association's servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Community in a given period of time. You agree that the Alzheimer's Association has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Community. You further acknowledge that the Alzheimer's Association reserves the right to modify these general practices and limits from time to time.
Modifications to the Community Pages
The Alzheimer's Association reserves the right at any time and from time to time to modify or discontinue the Community (or any part thereof) with or without notice. You agree that the Alzheimer's Association shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Community.
Termination
You agree that, in addition to or in lieu of other forms of sanction such as a written or verbal warning or suspension, the Alzheimer's Association may, without prior notice to you, immediately terminate your usage of, and access to, the Community. Cause for such termination shall include, but not be limited to, (a) breaches or violations of these guidelines or other associated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Community (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, and/or (g) engagement by you in fraudulent or illegal activities in connection with the Community. Termination of your participation in the Community includes (a) removal of access to all offerings within the Community, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Community. Further, you agree that all terminations for cause shall be made in the Alzheimer's Association's sole discretion and that the Alzheimer's Association shall not be liable to you or any third party for any termination of your use and/or participation in or access to the Community.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
- YOUR USE OF THE COMMUNITY IS AT YOUR SOLE RISK. THE COMMUNITY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE ALZHEIMER'S ASSOCIATION AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
- THE ALZHEIMER'S ASSOCIATION AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE COMMUNITY WILL MEET YOUR REQUIREMENTS; (ii) THE COMMUNITY WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS, IF ANY, THAT MAY BE OBTAINED FROM THE USE OF THE COMMUNITY WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, OR INFORMATION OBTAINED BY YOU THROUGH THE COMMUNITY WILL MEET YOUR EXPECTATIONS; AND (v) ANY ERRORS IN THE COMMUNITY OR ITS SUPPORTING SYSTEMS WILL BE CORRECTED.
- ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE COMMUNITY IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
- NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE ALZHEIMER'S ASSOCIATION THROUGH OR FROM THE COMMUNITY SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE GUIDELINES.
Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE ALZHEIMER'S ASSOCIATION AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE ALZHEIMER'S ASSOCIATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE COMMUNITY; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE COMMUNITY; OR (iv) ANY OTHER MATTER RELATING TO THE COMMUNITY.
General Information
Entire Agreement
These guidelines constitute the entire agreement between you and the Alzheimer's Association and govern your use of the Community, superseding any prior agreements between you and the Alzheimer's Association with respect to the Community.
Choice of Law and Forum
These guidelines and the relationship between you and the Alzheimer's Association shall be governed by the laws of the State of Illinois without regard to its conflict of law provisions. You and the Alzheimer's Association agree to submit to the personal and exclusive jurisdiction of the courts located within the Cook County, Illinois.
Waiver and Severability of Terms
The failure of the Alzheimer's Association to exercise or enforce any right or provision of these guidelines shall not constitute a waiver of such right or provision. If any provision of these guidelines is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the guidelines remain in full force and effect.
Statute of Limitations
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of the Community or the guidelines must be filed within one (1) year after such claim or cause of action arose or be forever barred.
